Terms and Conditions

Welcome to IssuePay. By accessing or using IssuePay, you agree to these Terms and Conditions. If you do not agree, do not use the platform.

1. Platform Services

IssuePay provides digital services that may include job posting and recruitment tools, application tracking, profile and resume tools, AI-powered features, communication features, and premium subscription capabilities.

2. Eligibility and Accounts

  • You must be at least 16 years old to use IssuePay. IssuePay is not intended for children under 13. If you are under 13, do not use this platform. If we become aware that a child under 13 has provided personal data, we will delete it immediately.
  • If you are between 16 and 19 years old and reside in Thailand, you may be required to obtain parental or guardian consent under Thai law (PDPA) before using IssuePay. By registering, you confirm that any required consent has been obtained.
  • You must provide accurate account information and keep your credentials secure.
  • You are responsible for all activity that occurs on your account.
  • We may suspend or terminate accounts for abuse, fraud, policy violations, or legal reasons.

3. Job and Recruitment Features

IssuePay provides functionality for organizations to post job offers and for users to apply. By using these features:

  • Applicants are responsible for the accuracy and legality of submitted data.
  • Organizations are responsible for lawful, accurate job postings and hiring activity.
  • IssuePay is a platform provider and does not guarantee hiring outcomes or candidate suitability.
  • Interactions and agreements between applicants and organizations are their own responsibility.

4. AI-Powered Features

IssuePay offers AI-powered features including a Career Agent (which can automatically discover and apply for jobs on your behalf) and an ATS Agent (which assists organizations in screening, scoring, and ranking candidates).

  • To provide these features, your profile data, CV content, job application information, and work history may be sent to and processed by AI models operated by Microsoft Azure OpenAI.
  • AI-generated screening scores and rankings are assistive tools only and do not constitute final hiring decisions. Organizations using ATS features must ensure that any hiring decision influenced by AI output is subject to meaningful human review before acting on it. No candidate may be rejected based solely on AI scoring.
  • You may enable or disable AI features through your account settings. Disabling the Career Agent stops automatic job applications going forward.
  • IssuePay does not guarantee the accuracy, completeness, or fitness of any AI-generated output.

5. Data Responsibilities for Organizations

Organizations that use IssuePay to collect and process candidate personal data act as independent data controllers for that data. IssuePay acts as a data processor on their behalf. By using IssuePay's recruitment features, organizations accept responsibility for:

  • Complying with applicable data protection laws in their jurisdiction, including GDPR, CCPA/CPRA, LGPD, PIPEDA, PDPA, POPIA, and equivalent laws.
  • Providing candidates with appropriate privacy notices explaining how their data will be used in the hiring process.
  • Ensuring that AI-assisted screening results are never used as the sole basis for consequential hiring decisions without human review.
  • Maintaining documentation demonstrating that human review of AI recommendations occurred, as required by applicable law.
  • Responding to candidate data rights requests (access, correction, deletion, objection) within required timeframes.
  • Notifying relevant authorities of data breaches where required by law.

6. User Content and Conduct

  • You retain responsibility for content you upload, publish, or submit.
  • You must not upload unlawful, infringing, deceptive, or harmful content.
  • You must not misuse platform features, attempt unauthorized access, or disrupt services.

7. Subscriptions, Credits, and Payments

Paid features may be offered via monthly/annual plans or other purchase models. Pricing and feature availability may change over time.

Unless required by applicable law, payments for digital services are generally non-refundable once access to paid features is granted.

8. Third-Party Services

IssuePay integrates with third-party services including Microsoft Azure OpenAI (AI processing), Stripe (payments), Amazon Web Services (file storage), Google and GitHub (OAuth authentication), Sentry (error monitoring), and Umami (privacy-friendly analytics). Your use of those services may be subject to their own terms and policies.

9. Availability and Changes

We may modify, suspend, or discontinue parts of the platform at any time, including features, limits, and plan entitlements.

10. Intellectual Property

Except for user-provided content, all platform software, branding, and materials are owned by IssuePay or its licensors and are protected by applicable laws.

11. Disclaimer

IssuePay is provided on an "as is" and "as available" basis without warranties of any kind, to the maximum extent permitted by law.

12. Limitation of Liability

To the maximum extent permitted by law, IssuePay is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, opportunities, or profits.

Where liability cannot be excluded, total liability is limited to amounts paid by you to IssuePay in the 12 months before the event giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless IssuePay from claims arising out of your use of the platform, your content, or your violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. However, mandatory consumer protections and data rights applicable in your jurisdiction are not waived by this agreement. In particular:

  • EU/UK residents: Your rights under GDPR and UK GDPR are preserved in full.
  • California residents: Your rights under CCPA/CPRA apply and cannot be waived.
  • Brazilian residents: Your rights under LGPD apply and cannot be waived.
  • Canadian residents: Your rights under PIPEDA and applicable provincial law (including Quebec Law 25) are preserved.
  • All other jurisdictions: Mandatory local consumer and data protection rights are preserved.

15. Updates to Terms

We may update these Terms periodically. Continued use after updates constitutes acceptance of the revised Terms.
